The appeal for the Whakaari White Island owners, over its 2019 eruption conviction, has been delayed
In a minute released today, Justice Mathew Downs said the hearing has been adjourned until further notice.
The appeal by island owners Whakaari Management Limited, was due to be heard in the Auckland High Court on Monday.
WML was fined one million dollars and had to pay eruption survivors and victim's families
The appeal will focus on whether WML managed a workplace and had a health and safety duty.
The High Court will decide if the claims amount to a miscarriage of justice.
